Section 301 List#4A – Effective September 1, 2019 Based on Entry Date

USTR finally published details regarding implementation of Section 301 List#4A and List#4B tariffs. As mentioned earlier this week, List#4A will be effective September 1, 2019 while List#4B will be effective December 15, 2019. USTR has confirmed that these dates are based on entry date.

Please note that September 1, 2019 falls on a Sunday. Importers who have shipments subject to List#4A that are scheduled to arrive on Saturday, August 31, 2019 or before, are highly recommended to contact our entry operations team to make sure applicable entries are submitted by Saturday, August 31, 2019. While we can submit the entries for applicable shipments by August 31, 2019, we cannot guarantee that Customs will release the shipment prior to that date. If Customs does not release the shipment until September 1, 2019, then the goods will still be subject to the tariff where applicable

Shipments that arrive on or after September 1, 2019 will be subject to List#4A if the product falls under the scope of the tariff numbers on the list regardless of whether we submit the entry prior to this date.

Exclusion Process for List#4
On a separate note, the USTR publication also did confirm that they will open an exclusion process for list#4. The exact date of the opening of the exclusion process is still to be determined.

Exclusion Process for List#3
Please note that the list#3 exclusion process is still open, but will be closing on September 30, 2019. Importers who have an interest in applying for a list#3 exclusion should begin the process ASAP.
